Please read these Terms & Conditions carefully before using our website, mobile applications, or any services offered by Oxi9 Essentials Private Limited. By accessing or using our platform, you agree to be bound by these Terms & Conditions.

1. ACCEPTANCE OF TERMS

By accessing or using the website https://oxi9.in, the Oxi9 mobile applications (Android and iOS), or any services provided by Oxi9 Essentials Private Limited ("Oxi9", "we", "us", or "our"), you ("User", "you", or "your") agree to comply with and be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not access or use our platform or services.

These Terms constitute a legally binding agreement between you and Oxi9 Essentials Private Limited, a company incorporated under the Companies Act, 2013, with its registered office in India.

2. ELIGIBILITY

2.1 You must be at least 18 years of age to create an account, make purchases, or use our services. If you are between 13 and 17 years of age, you may use our platform only with the consent and supervision of a parent or legal guardian.

2.2 By using our platform, you represent and warrant that:

a) You are a resident of India or accessing the platform lawfully from your jurisdiction;

b) You have the legal capacity to enter into a binding agreement;

c) You are not barred from using our services under any applicable law.

2.3 Oxi9 reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion, including in cases where eligibility requirements are not met.

3. USER ACCOUNTS

3.1 Registration: To access certain features of our platform, you may be required to create a user account by providing accurate, current, and complete information including your name, email address, phone number, and a secure password.

3.2 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials. You agree to:

a) Notify us immediately at care@oxi9.in if you suspect any unauthorized use of your account;

b) Ensure you log out of your account after each session, especially on shared devices;

c) Not share your credentials with any third party.

3.3 Accuracy of Information: You agree to keep your account information up to date. Oxi9 shall not be liable for any loss arising from inaccurate or incomplete account information provided by you.

3.4 Account Termination: Oxi9 reserves the right to suspend or permanently terminate your account if we reasonably believe that you have violated these Terms, provided false information, or engaged in any fraudulent or unlawful activity.

4. MOBILE APPLICATIONS

4.1 Oxi9 offers mobile applications for Android and iOS platforms ("App") to enhance your experience with our beauty products, salon management tools, appointment booking, and related services.

4.2 License: Subject to these Terms, Oxi9 grants you a limited, non-exclusive, non-transferable, revocable license to download and use our App on your personal mobile device for personal, non-commercial purposes.

4.3 App Updates: We may release updates to the App from time to time. Certain features may require you to update the App to the latest version. Oxi9 is not responsible for any issues arising from your use of an outdated version.

4.4 Device Permissions: The App may request access to certain device features such as camera, contacts, location, and notifications. You may manage these permissions through your device settings. Certain features may not function properly if permissions are restricted.

4.5 You agree not to: reverse engineer, decompile, modify, or create derivative works of the App; use the App for any unlawful purpose; or attempt to gain unauthorized access to any part of our system.

5. PRODUCTS

5.1 Oxi9 offers a wide range of beauty and personal care products under its proprietary brands including "Oxi9 Essentials", "Oxi9 Professionals", "Oxi9 Colours", "Oxi9 Home", "Beauty by Oxi9", "Oxi9 Wellness", and "Oxi9 Nutrition", among others (collectively, "Products").

5.2 Product Descriptions: We make every effort to display accurate descriptions, images, and specifications of our Products. However, slight variations in colour, texture, or appearance may occur due to screen display differences or product batch variations. Such variations do not constitute a defect.

5.3 Product Availability: All Products are subject to availability. Oxi9 reserves the right to limit quantities, discontinue Products, or modify product offerings at any time without prior notice.

5.4 Personal Care & Allergy Disclaimer: Our personal care products are formulated using carefully selected ingredients. However, individual skin types and sensitivities vary. We strongly recommend that you review the ingredient list before use. If you have known allergies, a skin condition, or any pre-existing medical condition, please consult a qualified dermatologist or medical professional before using our products. Oxi9 shall not be held liable for any allergic reactions or adverse effects resulting from the use of our products.

6. BEAUTY SERVICES

6.1 Oxi9 provides a platform that connects users with beauty professionals and salons offering services such as haircare, skincare, makeup, spa treatments, and other personal grooming services ("Beauty Services").

6.2 Oxi9 acts as an intermediary technology platform facilitating access to Beauty Services. The actual delivery of Beauty Services is performed by independent beauty professionals or partner salons ("Service Providers").

6.3 Oxi9 does not guarantee the availability, quality, or outcome of any Beauty Service. Users are encouraged to review Service Provider profiles, ratings, and reviews before booking.

6.4 Any concerns or disputes regarding the quality of Beauty Services should be raised directly with the respective Service Provider. Oxi9 will use reasonable efforts to assist in dispute resolution but shall not be held liable for the acts or omissions of independent Service Providers.

7. APPOINTMENT BOOKING

7.1 Our platform allows you to book appointments with beauty professionals and salons through https://oxi9.in or the Oxi9 mobile application.

7.2 Booking Confirmation: An appointment is confirmed only upon receipt of a confirmation notification via email or SMS. Oxi9 does not guarantee availability until a confirmation is issued.

7.3 Rescheduling: You may request to reschedule an appointment subject to availability and the cancellation policy of the Service Provider. Rescheduling requests must be made at least 24 hours before the scheduled appointment.

7.4 No-Show Policy: Failure to appear for a confirmed appointment without adequate prior notice may result in a cancellation fee or suspension of your booking privileges on the platform.

7.5 Service Provider Rights: Oxi9 and its Service Providers reserve the right to decline, modify, or cancel any booking in circumstances including but not limited to unavailability of staff, safety concerns, or technical issues.

8. PAYMENTS

8.1 Payment Methods: Oxi9 accepts payment through various methods including credit cards, debit cards, UPI, net banking, digital wallets, and other payment modes available on our platform at the time of checkout. All transactions are processed through secure, PCI-DSS compliant payment gateways.

8.2 Payment Authorization: By providing payment information, you authorize Oxi9 and its designated payment processors to charge the applicable amount for your order or booking.

8.3 Failed Transactions: In the event of a failed transaction, Oxi9 shall not be liable. If an amount is debited from your account but an order is not confirmed, the amount will typically be reversed within 5-7 business days, subject to your bank's processing timelines.

8.4 Unauthorized Charges: If you notice any unauthorized transactions on your account related to https://oxi9.in, please verify with your family members or authorized users before contacting us. Report any unauthorized charge within 60 days of the transaction to care@oxi9.in to initiate an investigation.

8.5 GST and Taxes: All applicable Goods and Services Tax (GST) and other statutory levies will be added to the order value as per prevailing Indian tax regulations and shall be borne by the customer.

9. PRICING

9.1 All prices displayed on https://oxi9.in are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

9.2 Oxi9 reserves the right to change product prices, service charges, or subscription fees at any time without prior notice. The price applicable to your order shall be the price displayed at the time of placing the order, subject to any corrections for pricing errors.

9.3 Pricing Errors: Despite our best efforts, pricing errors may occasionally occur. In such cases:

a) If the correct price is lower than the displayed price, we will charge the lower amount;

b) If the correct price is higher than the displayed price, we will cancel the order and notify you promptly.

9.4 Promotional Pricing: Discounts, offers, and promotional prices are valid for a limited period and may be withdrawn at any time without notice. Promotional offers cannot be combined unless explicitly stated.

10. CANCELLATION POLICY

10.1 Order Cancellation by Customer: You may cancel an order before it has been dispatched by contacting our customer care team at care@oxi9.in or calling 91-7490009496. Once an order has been dispatched, it cannot be cancelled and must be processed as a return.

10.2 Appointment Cancellation: Appointments may be cancelled up to 24 hours before the scheduled time without any penalty. Cancellations made within 24 hours of the appointment may attract a cancellation fee, as applicable.

10.3 Cancellation by Oxi9: Oxi9 reserves the right to cancel orders in the following circumstances:

a) Product is out of stock or unavailable;

b) Suspected fraudulent or unauthorized transaction;

c) Pricing errors on the platform;

d) Incomplete or inaccurate customer information;

e) Failure of payment authorization.

10.4 Bulk Orders: Oxi9 may cancel orders classified as bulk orders, which include situations where:

a) Products are ordered in quantities suggesting commercial resale rather than personal use;

b) Multiple orders are placed to the same address for the same product;

c) Orders are placed using malpractice or abuse of promotional offers.

10.5 Refund on Cancellation: For valid cancellations, refunds will be processed to the original payment method within 7-10 business days, subject to your bank's processing timelines. Promotional vouchers used in cancelled orders may not be refunded.

11. SHIPPING

11.1 Oxi9 ships products across India through reputable logistics partners. We endeavour to dispatch confirmed orders within 24 to 48 hours of order placement on business days.

11.2 Delivery timelines may vary based on delivery location, product availability, logistics partner operations, and external factors beyond our control (such as public holidays, natural disasters, or disruptions to logistics networks).

11.3 Risk and Title: Title to and risk of loss for all products shall pass to you upon delivery to the shipping address provided at the time of order.

11.4 Incorrect Address: Oxi9 shall not be responsible for non-delivery or delayed delivery resulting from an incorrect or incomplete shipping address provided by you.

11.5 International Shipping: At this time, Oxi9 ships only within India. Any orders placed with addresses outside India will not be processed.

12. RETURNS

12.1 Return Eligibility: Products may be returned within 7 days of delivery if they are damaged, defective, or not as described, subject to the conditions below:

a) The product must be unused and in its original packaging;

b) A clear photograph of the damaged or defective product must be provided at the time of raising the return request;

c) Certain products such as opened personal care items, consumables, and hygiene-sensitive goods may not be eligible for return due to health and safety reasons.

12.2 Return Process: To initiate a return, please contact our customer care team at care@oxi9.in within the return window. Our team will guide you through the return process, including pickup arrangements where applicable.

12.3 Refunds: Once the returned product is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be credited to your original payment method within 7-10 business days.

12.4 Exchange: Subject to availability, we may offer an exchange for the same or a similar product in lieu of a refund.

13. INTELLECTUAL PROPERTY

13.1 All content available on https://oxi9.in and the Oxi9 mobile applications, including but not limited to text, graphics, logos, icons, images, audio, video, software, product names, and brand identifiers, is the exclusive property of Oxi9 Essentials Private Limited or its licensors and is protected under applicable Indian intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

13.2 You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publish, transmit, display, or create derivative works from any content on the platform without prior written permission from Oxi9.

13.3 All brand names, product names, and trade marks displayed on the platform are trademarks or registered trademarks of Oxi9 Essentials Private Limited or third parties as applicable. Unauthorized use of any trademark is strictly prohibited.

13.4 Personal Use Exception: You may print or download limited portions of the platform content for personal, non-commercial reference, provided you acknowledge https://oxi9.in as the source and do not modify the content.

14. USER RESPONSIBILITIES

14.1 You agree to use https://oxi9.in and the Oxi9 mobile applications only for lawful purposes and in a manner consistent with all applicable laws and regulations.

14.2 You are solely responsible for all content, data, and information you submit or upload to the platform.

14.3 You agree to maintain the accuracy of your account information and to promptly update it as and when required.

14.4 You acknowledge that you are responsible for all activities conducted through your account and shall be liable for any misuse.

14.5 You agree not to attempt to gain unauthorized access to any portion of the platform, other user accounts, or any systems connected to the platform.

15. REVIEWS & USER CONTENT

15.1 Oxi9 may allow users to post reviews, ratings, comments, and other content ("User Content") on the platform in relation to products, services, or beauty professionals.

15.2 By submitting User Content, you grant Oxi9 a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, modify, and distribute such content in connection with the operation of our platform and business.

15.3 You represent and warrant that your User Content:

a) Is original and does not infringe any third-party intellectual property rights;

b) Is not false, misleading, defamatory, abusive, or unlawful;

c) Does not contain any personal information of third parties without their consent.

15.4 Oxi9 reserves the right to remove or edit any User Content that violates these Terms or is otherwise inappropriate, without notice to you.

15.5 Oxi9 does not endorse or verify User Content and is not responsible for its accuracy or reliability.

16. PROHIBITED ACTIVITIES

You agree not to engage in any of the following activities on or in connection with the Oxi9 platform:

16.1 Posting or transmitting content that is defamatory, obscene, abusive, threatening, hateful, or otherwise unlawful;

16.2 Impersonating any person or entity, or falsely representing your affiliation with any person or entity;

16.3 Uploading or transmitting any software, code, or material containing viruses, malware, or any other harmful programs;

16.4 Conducting or facilitating any unauthorized commercial activity, including pyramid schemes or spam;

16.5 Scraping, crawling, or using automated tools to collect data from the platform without express written permission;

16.6 Attempting to interfere with, disrupt, or compromise the integrity or security of the platform or its associated infrastructure;

16.7 Using the platform in any manner that could damage the reputation of Oxi9, its employees, partners, or users;

16.8 Violating any applicable law or regulation, including those relating to consumer protection, data privacy, or electronic commerce.

17. PRIVACY

17.1 Your privacy is important to us. Our collection, use, storage, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference and available at https://oxi9.in.

17.2 By using our platform, you consent to the collection and use of your information as described in our Privacy Policy.

17.3 We may share your information with third parties such as payment processors, logistics partners, and service providers strictly as necessary to deliver our services and in compliance with applicable Indian data protection laws.

17.4 We may disclose your information to government authorities or law enforcement agencies where required by law or to prevent fraud, illegal activity, or physical harm.

18. THIRD PARTY SERVICES

18.1 Our platform may contain links to third-party websites, services, or applications ("Third Party Services"). These links are provided for your convenience and do not constitute an endorsement or recommendation by Oxi9.

18.2 Oxi9 has no control over and is not responsible for the content, privacy practices, or terms of use of Third Party Services. Your access to and use of Third Party Services is entirely at your own risk.

18.3 Certain features on our platform, such as payment processing, map services, social login, and analytics, may be powered by third-party providers. These providers have their own terms and privacy policies that apply to your use of such features.

18.4 Oxi9 shall not be liable for any loss or damage arising from your interaction with Third Party Services, including but not limited to data breaches, service outages, or financial loss.

19. LIMITATION OF LIABILITY

19.1 The Oxi9 platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

19.2 Oxi9 does not warrant that the platform will be uninterrupted, error-free, free of viruses or other harmful components, or that defects will be corrected.

19.3 To the fullest extent permitted by applicable law, Oxi9 shall not be liable for any:

a) Indirect, incidental, special, punitive, or consequential damages;

b) Loss of profits, data, goodwill, or business opportunities;

c) Losses resulting from unauthorized access to or alteration of your account or data;

d) Losses resulting from your reliance on any content, product, or service on the platform.

19.4 In no event shall Oxi9's maximum aggregate liability to you for any claim arising out of or in connection with your use of the platform exceed the amount actually paid by you to Oxi9 in the three months immediately preceding the event giving rise to the claim, or INR 2,000 (Indian Rupees Two Thousand), whichever is higher.

19.5 No claim arising from your use of the platform may be brought more than one (1) year after the cause of action arose.

20. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Oxi9 Essentials Private Limited and its directors, officers, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

20.1 Your breach of these Terms;

20.2 Your violation of any applicable law or regulation;

20.3 Your infringement of any intellectual property or other rights of any third party;

20.4 Any content or information you submit to the platform;

20.5 Your use or misuse of the platform or any service offered through it.

21. GOVERNING LAW

21.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.

21.2 Any dispute, claim, or matter arising from or in connection with these Terms or your use of the Oxi9 platform shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

21.3 These Terms are compliant with the Information Technology Act, 2000, the Consumer Protection Act, 2019, and all other applicable Indian statutes as amended from time to time.

22. DISPUTE RESOLUTION

22.1 In the event of any dispute or grievance arising from your use of the Oxi9 platform, we encourage you to first contact our customer care team at care@oxi9.in to seek an amicable resolution.

22.2 If the matter is not resolved within 30 days of raising a complaint, either party may refer the dispute to arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, and the seat of arbitration shall be New Delhi, India.

22.3 The language of arbitration shall be English, and the arbitration award shall be final and binding on both parties.

22.4 Nothing in this clause shall prevent either party from seeking interim or injunctive relief from a competent court where necessary.

23. FORCE MAJEURE

23.1 Oxi9 shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to:

a) Natural disasters, earthquakes, floods, or extreme weather conditions;

b) Acts of God, war, terrorism, civil unrest, or government-imposed restrictions;

c) Pandemics, epidemics, or public health emergencies;

d) Strikes, industrial disputes, or labour shortages;

e) Disruptions to internet, power, or telecommunications infrastructure;

f) Actions or omissions of third-party logistics or service providers.

23.2 In such circumstances, Oxi9 will make reasonable efforts to notify affected users and resume normal operations as soon as practicable.

24. MODIFICATION OF TERMS

24.1 Oxi9 reserves the right to update, modify, or replace these Terms at any time. Any such changes will be posted on https://oxi9.in with a revised "Last Updated" date.

24.2 It is your responsibility to review these Terms periodically. Your continued use of the platform following the posting of revised Terms constitutes your acceptance of the changes.

24.3 If you do not agree with the revised Terms, you must discontinue your use of the platform. For material changes, we will make reasonable efforts to notify registered users via email or in-app notification.

GENERAL PROVISIONS

Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Oxi9.

Entire Agreement: These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Oxi9 Essentials Private Limited with respect to the subject matter hereof and supersede all prior agreements, representations, or understandings.

No Partnership: Nothing in these Terms shall be construed as creating a partnership, joint venture, agency, employment, or franchise relationship between you and Oxi9.

Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
